Motion to Dismiss Workflow with LexisNexis®
Upload a complaint and Harvey drafts a complete, fully cited motion to dismiss, researched against live LexisNexis case law, with you approving the research plan before drafting begins.
Important: This workflow will be automatically enabled for users with access to Harvey’s Ask LexisNexis® feature. To enable this for users with access to Lexis+® with Protégé™ only, please reach out to your Customer Success Manager or submit a request here.
What's New
Harvey now includes an agentic workflow that takes a complaint and produces a complete motion to dismiss, researched through jurisdiction-filtered LexisNexis searches. With the workflow, you can:
- Review a research plan with up to eight candidate grounds for dismissal, each rated by strength
- Approve the plan as-is, or add and drop arguments, before research and drafting begin
- Get a research memo for each argument covering the legal standard, the strongest cases, likely weaknesses, and adverse authority
- Each case in a memo includes a Bluebook citation, a direct link to the opinion on Lexis+® with Protégé™, its key holding, and how it applies to the complaint's allegations. Key cases are validated through Shepard's® Citations, with the Shepard's Signal™ reported.
- Draft for federal or state court, using the forum's procedural vehicle, pleading standard, and formatting
Why It Matters
Drafting a motion to dismiss is one of the most time-intensive tasks in early-stage litigation. This workflow brings the issue-spotting, jurisdiction-specific research, and drafting into a single review-and-approve loop. You start from a set of researched options rather than a blank page, and you still decide the theory of the motion.
How to Use
- Navigate to Library and select the Workflows tab.
- Locate and select the Motion to Dismiss workflow.
- Upload the complain and run the workflow.
- Review Harvey’s proposed research plan, including the detected forum, governing law, and candidate grounds. You will be able to:
- Approve the plan, or give feedback to add or drop arguments
- Review the research memo for each approved argument
- Review the drafted motion against the memos, the complaint citations, and the linked authority
Tip: For a state-court complaint, confirm the detected forum and procedural vehicle in the research plan before you approve it.
FAQs
Q: What if there's limited state authority on a state-law issue?
Where state authority is limited, Harvey supplements it with federal decisions applying that state's law.
Q: Are the citations generated from the model's memory?
No. The workflow retrieves cases through jurisdiction-filtered LexisNexis searches rather than relying on model memory. Each case in the research memos links to the opinion, so you can verify it before relying on it.
Q: Is the motion ready to be filed?
No. Harvey can make mistakes and errors may occur. Please verify every citation within the motion draft before any filing.
